Standard Operating Procedures

In compliance with New York Real Property Law Section 442-h, Nostra Haus Real Estate publishes the following Standard Operating Procedures. These procedures govern how we work with prospective homebuyers and apply to all licensed agents of the brokerage.

1. Prequalification of Prospective Homebuyers

Nostra Haus does not require buyers to be prequalified by a mortgage lender or to provide proof of funds before viewing properties. We believe in meeting buyers where they are in their process.

For buyers who would benefit from financing guidance, we are happy to introduce them to trusted local mortgage professionals who can walk them through prequalification, loan options, and what they can afford. We strongly recommend that buyers explore financing early in their search, but we do not condition our services on completing this step.

2. Identification of Prospective Buyers

Nostra Haus does not require government-issued photo identification as a condition of viewing properties. We collect basic contact information — name, phone number, email address — through normal professional intake before showing properties or providing substantive guidance. This information allows us to communicate effectively with our clients and maintain accurate records of our work together.

In specific circumstances — such as showings of vacant homes, properties owned by clients who request identification verification, or where local custom requires it — our agents may request additional identification at their professional discretion.

3. Buyer Agency Agreements

Effective August 17, 2024, the National Association of Realtors requires that any buyer working with a Realtor enter into a written buyer agreement before being shown any property listed on a multiple listing service. Nostra Haus complies with this requirement.

Before showing any MLS-listed property to a prospective buyer, we will provide and ask the buyer to sign a written buyer agreement. This agreement clearly states:

  • The services Nostra Haus will provide
  • The duration of the agreement
  • Compensation arrangements
  • Whether the relationship is exclusive or non-exclusive
  • The buyer’s right to work with other agents (in non-exclusive agreements)

Nostra Haus offers both exclusive and non-exclusive buyer agreements. We explain the differences between these options and the broader distinction between a customer relationship and a client relationship under New York agency law. We recommend that buyers choose the form of agreement that best fits their situation and goals, and we honor whichever form the buyer chooses.

Buyers may end a non-exclusive buyer agreement at any time per its terms. Buyers entering an exclusive buyer agreement may terminate per the conditions specified in the agreement itself.

Effective Date and Updates

These Standard Operating Procedures are effective as of May 13, 2026.

Nostra Haus reserves the right to update these procedures from time to time. Updates will be reflected on this page. Material changes will be dated. The most recent version of our SOPs will always be available at this URL.
